หากพูดถึงสมุนไพรที่ได้รับความสนใจจากประชาชน คงไม่มีอะไรที่จะอยู่ในกระแสความสนใจในปัจจุบันมากไปกว่ากัญชาและกัญชง พืชกัญชาและกัญชงมีชื่อทางวิทยาศาสตร์ว่า Cannabis sativa L. เดิมจัดอยู่ในยาเสพติดประเภท 5 แต่ในปัจจุบัน รัฐบาลมีนโยบายสนับสนุนการใช้ประโยชน์จากกัญชาและกัญชงอย่างต่อเนื่อง โดยล่าสุดตามประกาศกระทรวงสาธารณสุข เรื่อง ระบุชื่อยาเสพติดให้โทษในประเภท 5 พ.ศ. 2565 พืชกัญชาและกัญชง มิได้ถูกระบุให้เป็นยาเสพติดให้โทษอีกต่อไป มีเพียงสารสกัดจากส่วนต่างๆ ของพืชกัญชาและกัญชงที่มีปริมาณสารออกฤทธิ์ต่อจิตประสาท Tetrahydrocannabinol หรือ THC มากกว่าร้อยละ 0.2 โดยน้ำหนักเท่านั้นที่ยังคงเป็นยาเสพติดอยู่ ทั้งนี้กัญชา และกัญชง และสารสกัดต้องมาจากผลผลิตที่ได้จากการปลูกภายในประเทศ โดยประกาศฉบับนี้จะมีผลให้บังคับใช้ได้ในวันที่ 9 มิถุนายน 2565 เพื่อให้ภาครัฐได้มีเวลาจัดทำพระราชบัญญัติกัญชาที่มีแนวทางการใช้ประโยชน์ และการควบคุมกำกับดูแลได้อย่างเรียบร้อยต่อไป นอกจากนี้ กฎกระทรวงตามพระราชกิจจานุเบกษา ยังเปิดโอกาสให้ทั้งบุคคลธรรมดา นิติบุคคล วิสาหกิจชุมชน หรือภาคเอกชน ขออนุญาตปลูกและสกัดกัญชงได้ ตั้งแต่วันที่ 29 มกราคม 2564 เพื่อสนับสนุนผู้ประกอบการภายในประเทศ
When it comes to the herbs that are becoming increasingly popular, none can compete with cannabis and hemp. Also known as Cannabis sativa L., these plants were classified as Type-5 narcotics, but the Thai government is now striving to promote their usage continuously. According to the latest notification of the Ministry of Public Health Re: List of Type-5 Narcotics B.E.2565 (2022), cannabis and hemp are no longer included in the list. Nevertheless, extracts obtained from various cannabis or hemp parts that contained tetrahydrocannabinol (THC), a psychoactive compound exceeding 0.2% by weight, is an exception and remains on said list. Cannabis, hemp, and their botanicals must be cultivated in or come from the sources within Thailand only. This notification will come into force on June 9, B.E.2565 (2022) in order to allow the government some time to efficiently and properly enact the Cannabis Act that comprises the guidelines on cannabis usage and control. Moreover, the Ministry’s regulations, in agreement with the Royal Thai Government Gazette, also allow an individual, a juristic person, a community enterprise, and a private business to apply for a permission to cultivate and extract hemp, starting from January 29, B.E.2564 (2021), with the objective to support Thai entrepreneurs.
